「米軍駐留は憲法違反」との砂川判決を受けて当時のマッカーサー駐日大使が、同判決の破棄を狙って藤山外務大臣に最高裁への跳躍上告を促す外交圧力をかけたり、田中最高裁長官と密談したりするなどの介入を行っていたこと、また田中長官自身が、マッカーサー大使と面会した際に「伊達判決は全くの誤り」と一審判決破棄・差し戻しを示唆していたこと、上告審日程やこの結論方針をアメリカ側に漏らしていたことが明らかになっている。

　以下紹介する公文書は、在日米大使館マッカーサ ー大使が、1959年8月3日に米国務長官に宛てて出した航空書簡(G73) である。 米国務省が2013年1月に開示した。田中長官が、法廷で当事者に通知する前に米国に裁判日程を洩らしていることが推測される公文書である。

　　During conversation at house mutual friend, Supreme Court Chief Justice Kotaro told DCM he now thought decision in Sunakawa case probable in December. 

　共通の友人宅での会話の中で、田中耕太郎裁判長（注： 当時第2代最高裁長官(1950年3月―1960年10月) は、在日米大使館主席公使（注:William K. Leonhart(1919-1997)公使・参事官として在日米大使館勤務(1958 年12月―1962年8月) ）に対し「砂川事件の判決は、おそらく12月であろうと今考えている」と語った。

　　Chief Justice said that Defense attorneys trying every legal device possible to delay completion Court’s consideration, but he is determined to confine issue to question of law and not of fact. 

　弁護団は、裁判所の結審を遅らせるべくあらゆる可能な法的手段を試みているが、裁判長は、争点を事実問題ではなく法的問題に閉じ込める決心を固めていると語った。


　　On this basis he believed oral arguments could be completed in about three weeks time, with two sessions, morning and afternoon each, per week beginning early in September. 

　こうした考えの上に立ち、彼は、口頭弁論は、9月初旬に始まる週の1週につき2回、いずれも午前と午後に開廷すれば、およそ3週間で終えることができると確信している。


　　Problem would arise thereafter because so many of his fourteen Associate Justices like to argue there views at great length. 

　問題は、その後で、生じるかもしれない。というのも彼の14人の同僚裁判官たちの多くが、それぞれの見解を長々と弁じたがるからである。


　　Chif Justice added he hoped Court’s Deliberations could be carried out in manner which would produce substantial unanimity of decision and avoid minority opinions which could “unsettle” public opinion.

　裁判長は、結審後の評議は、実質的な全員一致を生み出し、世論を揺さぶる素になる少数意見を回避するようなやり方で運ばれることを願っていると付言した。

　　Comment : Embassy has recently had number of indications from foreign Office and liberal Democratic Party sources that GOJ decision to defer presentation of new Mutual Security Treaty until regular Diet session opening in December was influenced by Supreme Court’s inability to bring Sunakawa case to decision by late summer or early fall, as originally contemplated《G-81》.

　コメント:大使館は、最近外務省と自民党の情報源より、日本政府が新日米安全保障条約の提出を12月開始の通常国会まで遅らせる決定をしたの は、砂川事件判決を最高裁が、当初目論んでいた(G-81)、晩夏ないし初秋までに出すことが不可能だということに影響されたものであるとの複数の示唆を得た。

　　These sources state that while status Sunakawa case not decisive element in postponement submission of new Treaty to Diet, it was recognized that fact that Sunakawa case still under consideration would give Socialist and other opposition debating points which could otherwise be avoided.

　これらの情報源は、砂川事件の位置は、新条約の国会提出を延期した決定的要因ではないが、砂川事件が係属中であることは、社会主義者（注：実質的には社会党を指す）やそのほかの反対勢力に対し、そうでなければ避けられたような論点をあげつらう機会を与えかねないのは事実だと認めている。


　　 Moreover, Socialists have committed themselves heavily to District Court’s finding that the stationing of US forces in Japan is unconstitutional. 

　加えて、 社会主義者たちは、地裁法廷の米軍の日本駐留は憲法違反であるとの決定に強くコミットしている。


　　If Supreme Court reverses District Court and decides case favorably to the Government at time which coincides with Diet discussions, climate of public opinion in support of the new Treaty would be materially assisted, and the Socialists, in a form of political judo, thrown by the force of their own exertions.

　もし、最高裁が、地裁判決を覆し、政府側に立った判決を出すならば、新条約支持の世論の空気は、決定的に支持され、 社会主義者たちは、政治的柔道の型で言えば、自分たちの攻め技が祟って投げ飛ばされることになろう。
